Why does Simcoe County want to become the monopoly service provider for water supply and wastewater via a regional network of underground pipes?

October 22, 2014

Is it “For the Greater Good”: to maximize the value of natural monopoly services to the the current 446,063 current residents as is the case for solid waste, ambulance, forests, long term care?

Simcoe County logo

Or is it to set into place effective corporate control over the water and sewer revenue of one of the fastest growing areas in Canada?

Each mayor and deputy mayor in Simcoe County’s 16 municipalities automatically sits on county council when they’re elected.

Question: Is there an undisclosed, personal, pecuniary interest in everyone running for mayor or deputy mayor in the October 27th election because economic theory indicates profit-maximizing control of monopolies leads to avoidable, inefficient economic rents? These over-and-above market-justified cash flows can create a series of perceived and real conflicts of interest (ie. opportunistically increase the net present value of the lifetime earnings of new and former county politicians and county senior staff).

Pecuniary Interest Disclosure: Since January 2, 2014, I have been a registered candidate for Deputy Mayor of Springwater Township. My only pecuniary interest is part ownership of a residential property in Midhurst which has used well water and septic system for the last 54 years. The perceived forced, future hookup to water and sewers that would come with the Midhurst Secondary Plan, MSP has decreased the market value of this family asset. I restrict my business consulting to individual and groups of franchisees in the North American business format franchise industry.

As a candidate for deputy mayor, I would oppose the privatization of water management in Springwater Township and the county if elected.

There are three of us vying for this position: the incumbent is an uber-staunch MSP supporter and the other one became a Midhurst resident in 2014, appears to be using robo calls, and filed his papers two or three days before the September 12th election deadline. David Donnelly estimates the market value of an approved Midhurst Secondary Plan at $40-billion.

Margaret Atwood talks about the “life-wrecking” Midhurst Secondary sprawl plan.

July 22, 2014

A question and answer video with Margaret Atwood in support of the Midhurst Ratepayers’ Association.

Published on 21 Jul 2014
Margaret Atwood speaks frankly about why supporting Midhurst is not just about ‘development’ but about taking a stand for farmland, shared water resources and keeping government accountable and transparent. “This is a life-wrecking event”.

How to contact Premier Kathleen Wynne.

Which of the three mainstream Ontario political parties should I vote for to stop the Midhurst Secondary Plan?

April 16, 2014

As far as destruction of farmland because of sprawl, none of them.

Ontario political leadersAccording to the the Midhurst Ratepayers’ Association’s Ms. Sandy Buxton, only Mike Schreinder of the Green Party has even said they oppose it.

Question:

Subject: Provincial political partys’ positions on Midhurst Secondary Plan, MSP

Date: April 15, 2014

Ms. Sandy Buxton
President
Midhurst Ratepayers’ Association

Ms. Buxton,

I was wondering if the MRA has asked Tim Hudak, Andrea Horwath and Kathleen Wynne if they would reverse the Special Rule and stop the MSP if elected/re-elected as the next Ontario premier?

I think Springwater Township residents might want to know as we maybe facing a provincial election very soon.

Regards, Les

Answer:

HI Les,

The MRA has approached all party leaders, including Mike Schreiner of the Green Party. Except for the latter, none has revealed their position on the MSP, nor have they committed to rescinding the special rule. To date, of all the local incumbents and potential candidates for Simcoe-Grey and Simcoe-North we’ve contacted, only MPPs Jim Wilson and Garfield Dunlop have publicly come forward to support our efforts. We still hope the other leaders and candidates will recognize the importance of this cause and join us. We are continuing to lobby them.

President, MRA

The “Special Rule” (informally known, I am told, as the “Geranium Rule”) was brought in in June 2012 and it is explained here by AWARE Simcoe. pdf

An exemption to provincial law created by the stroke of a minister’s pen can be reversed likewise

Are there reasonable grounds for a provincial investigation into events surrounding the Midhurst Secondary Plan?

March 30, 2014

I do not know.

In deep waters

How wide the net could be cast is also an important question.

Why are the Midhurst sprawl-miesters running scared by doing an “end run” to get their re-zoning orders?

March 24, 2014

The poor boys thought scoring was a “Done Deal” but others and the law appear to disagree.

Demanding the Ontario Municipal Board, OMB give them their precious re-zoning orders “RFN (full 10,000 houses):
  • before the environmental assessments are done (a no-n0, especially see RAMSAR certified Minesing Wetlands),
  • before the  current house negro township Council majority gets their increasingly-apparent doofus rubber-stamp on the crucial re-zoning orders,
  • before Margaret Atwood and Friends (Michael  Ondaatje, Joseph Boyden, Maude Barlow, Neil & Pegi Young, and John Ralston Saul) show up at Nursery Road and Springwater Park-Camp Nibi,
  • before  the township’s Oct 27th township election allows democracy to do its purging work again,
  • before a new Minister (Linda Jeffrey quits Ontario cabinet to run for Brampton mayor) is appointed,
  • before a former Kingston municipal politician retires and passes Ontario’s 1st anti-SLAPP law, and
  • before Premier Wynne calls a spring provincial election, which would give her ….

….the pretense for a ministerial order overthrowing 100% of the financially reckless, environmentally-catastrophic Midhurst Secondary Plan.

With the stroke of a pen.

End Run Analogy: Colloquially, it has come to mean an attempt to avoid a difficult situation by dodging it without confronting it directly, or to attempt to circumvent someone’s authority by appealing to a different authority. Wikipedia

Come out to Council meeting tonight at 5:30 pm or the county museum tomorrow night to smell the fear and loathing.

Are Springwater Township Council members & staff competently managing their own developer-originated, litigation-derived contingent liabilities?

March 18, 2014

Every corporation must disclose and protect against material risks and executives must manage and disclose something called contingent liability.

SLAPPs ON

From their initial response, this does not appear to be happening by the Corporation of the Township of Springwater

Without Prejudice but Not Confidential

Mayor Linda Collins
Corporation of the Township of Springwater
Minesing, Ontario

Mayor Collins,

This is a follow-up from my verbal question at the March 17, 2014 general council meeting.

From their response, it is my conclusion that your senior staff will not be booking any financial liability whatsoever on their 2013 or 2014 audited financial statements having to do with this controversial, unprecedented activity by corporations that are on the public record as being extremely litigation-prone to those that do not yield unconditionally to their will.

Q1: Will you be instructing your senior staff to investigate and report back to Council in open session the range of potential financial loss(es) that may accrue to the Corporation of the Township of Springwater having to do with the initial cost of defence and potential final claim (trial and appeal) of a lawsuit(s) by a single or multiple parties?

A yes or no answer would be be appreciated, please. Other questions may arise from your answer or non-answer.

It is my understanding, that you, Council members, and senior staff have a professional and personal fiduciary duty to protect the Corporation from harm by acting in a commercially reasonably, fiscally prudent manner to protect future taxpayers’ interests.

I reserve distribution and publication rights to this document and unreservedly offer the same to the Corporation and individual members of Council. Clerk Daly; please formally record this correspondence and acknowledge such to me.
